Pre-Bankruptcy Fee Agreement

(Our pre-bankruptcy fee agreement explains the process. Bankruptcy is complex but that doesn't mean you shouldn't know what to expect).

I/WE the undersigned, hereby retain and employ David A. Casey in California for pre-bankruptcy representation. In order to determine which option is best for you, a pre-bankruptcy process is conducted. All fees collected through the pre-bankruptcy process will be applied to a Chapter 7 or Chapter 13 bankruptcy proceeding we may do. El Cajon Bankruptcy Attorney during our pre-bankruptcy review will give you the probably results before filing bankruptcy, keeping assets, debts, exemptions, etc.

The purpose of this fee agreement to place in writing the purpose of the pre-bankruptcy process and to explain what you will receive.

The purpose is to gather all of the financial information that is needed in a bankruptcy and to determine if a Chapter 7 or Chapter 13 is right for you. The pre-bankruptcy process of inputting the information you provide will provide a basis for determining what the specific issues are.

In this process, some people may pass the income portion of the "Means" test which may give the appearance of being able to file Chapter 7. However, after inputting all of the specific factors, they do not qualify thus a Chapter 13 may be a better option due to the exemptions allowed and being able to keep assets they would not be able to under a Chapter 7. Due to the certain aspects of the bankruptcy laws, there may be an occasion that when you should wait a short period of time before filing.

Far too often, some other law firms will file a Chapter 7 only to find that the trustee or the court orders the debtor to convert to a Chapter 13. This only costs you more money and delays the process. This is why the pre-bankruptcy process that my office provides, lowers the risk of this occurring.

After completing the pre-bankruptcy process, I will be able to determine what the issues are and determine how much the actual bankruptcy may cost. Even with the pre-bankruptcy process, it is still impossible to determine the total cost since the Trustee, the court or creditor’s actions could require additional attorney work, motions and court appearances. Any new work completed after filing bankruptcy is not dischargeable by the client. You can NOT use your credit card or ATM card to pay your retainer. Payment has to be made by cash, check or money order. All court filing fees are payable to David A. Casey if paid by money order or must be paid by cash.

The Bankruptcy Court has to approve all fees I charge you. I can not charge more than what they consider is reasonable for the services performed in a bankruptcy action. This applies to both Chapter 7 and Chapter 13.

Section 1. ALL pre-bankruptcy fees paid are applied to your over all bankruptcy attorney fees cost. ***

The pre-bankruptcy fees will also apply to a Chapter 13 bankruptcy action that is filed on your behalf. ***

Section 2. Your review in my office. 

Section 3. What the pre-bankruptcy fee covers:

(1) The initial consultation in my office. (30-45 minutes There is NO charge for this consultation!

(2) A packet portfolio is provided to put your paperwork in.

Included in the packet, is a questionnaire based on the estimated income you have indicated.

(3) Chapter 7 bankruptcy information booklet.

(4) A "Should Not Do" list of what NOT to do after coming into my office.

(5.) Inputing of all of your creditors and debt information into the bankruptcy software database. Inputting of all your personal property and values to determine exemptions. (Most of the time this takes 2-4 hours depending on the number of creditors).

(6) Calculating the "Means" test.

(7) I will then review all of the actual documents to see what problem(s) you may have, and what your options are to correct them. This includes a review of the exemptions under CCC 703 & CCC 704.

This review process on my part takes about 45 minutes to 1 hour of attorney time to complete this process.

(8) A second office consultation up to 45 minutes.

(9) Once all of the new data is entered, a third meeting is scheduled to review the draft of the Petition and all of the schedules A - J and the completed "Means" test. This is what the bankruptcy court will see.

(This office consultation takes up to one hour).

SECTION 4. Sign the bankruptcy fee agreement: After any problems have been resolved and you have your pre-bankruptcy credit counseling certificate, you are ready to file your bankruptcy case. So what was really accomplished in the pre-bankruptcy process was to complete all the forms of the actual bankruptcy that may best suit you. You, (both debtors if filing a joint return) would sign a fee agreement for either a Chapter 7 or Chapter 13 bankruptcy.

As you can see this is only part of the agreement for a pre-bankruptcy and we spell it out for you in writing what we are going to do.
